1. General Provisions

These General Terms and Conditions (GTC) apply to all public and online auctions conducted by Aurelia Fine Arts GmbH. By registering to bid, you accept these terms unconditionally.

2. Condition of Lots

All lots are sold "as is, where is." Condition reports are provided as a courtesy and represent an opinion, not a guarantee. Buyers are encouraged to inspect items prior to bidding.

3. Bidding and Hammer Price

The auctioneer exercises absolute discretion in accepting bids. The contract of sale is formed when the auctioneer brings down the hammer, accepting the highest bid.

4. Buyer's Premium & Taxes

A Buyer's Premium will be added to the hammer price. The rate is 25% up to €500,000, 20% for amounts between €500,001 and €5,000,000. Applicable VAT will be applied to the premium under the margin scheme.

5. Payment

Payment is due within seven (7) calendar days of the invoice date. Acceptable payment methods include bank wire transfer, certified check, or major credit cards (subject to a 2% surcharge).

6. Collection and Shipping

Lots will only be released upon receipt of full cleared funds. Buyers are responsible for arranging shipping. Any lots not collected within 30 days will incur daily storage fees.

1. Public Auctions (In-Person/Simulcast)

In accordance with EU consumer protection law, the statutory 14-day right of withdrawal does not apply to contracts concluded at public auctions where consumers have the opportunity to attend in person. Bids placed are legally binding.

2. Online-Only Timed Auctions (Distance Selling)

If you purchase an item as a consumer (not a business entity) exclusively via our online timed auction platform (without a live auctioneer), you possess a statutory right of withdrawal.

3. Right of Withdrawal (Online Timed Auctions Only)

You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

4. Exercising the Right of Withdrawal

To exercise the right of withdrawal, you must inform us (Aurelia Fine Arts GmbH, Kurfürstendamm 213, 10719 Berlin, [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or e-mail).

5. Effects of Withdrawal

If you withdraw from the contract, we shall reimburse to you all payments received from you, excluding the costs of delivery and return shipping, without undue delay and in any event not later than 14 days from the day we receive the returned goods in their original condition.
